Sets clear deadlines for filing vaccine-injury claims when the vaccine is one listed on the Vaccine Injury Table. If the vaccine was given before October 1, 1988, a claim must be filed within 28 months after October 1, 1988, and you cannot file if the first symptom or big worsening showed up more than 36 months after the shot. If the vaccine was given after October 1, 1988, you must file for an injury within 36 months after the first symptom or big worsening. For a death after October 1, 1988, a claim must be filed within 24 months after the death and no later than 48 months after the first symptom or big worsening that led to the death. If the Vaccine Injury Table is changed so someone becomes newly eligible or has a much better chance of getting compensation, that person can file within 2 years after the change takes effect. But no compensation is allowed if the death or injury happened more than 8 years before the table change. When a federal compensation petition is filed, state time limits to sue are paused from the filing date until the person either chooses to bring a civil lawsuit or withdraws the petition.
