No new federal flood insurance will be given in an area after December 31, 1971 unless the proper state or local government puts in place and enforces land‑use rules that the Administrator finds meet the land‑management standards in section 4102. State or local authorities may choose to allow repair of certain farm buildings that keep getting flooded or that were damaged so badly that repairs cost 50 percent or more of the building’s pre‑damage market value. Those repaired farm buildings must pay full risk‑based insurance rates. The Administrator can give technical help about wet flood‑proofing if resources allow, and flood insurance does not have to be offered for such a building unless it is wet flood‑proofed in a way the Administrator accepts. Any federal disaster aid cannot be used for those repaired farm buildings. “Agricultural structure” means a building used only for farm production, storage, raising, or drying. “Agricultural commodities” means farm products and livestock. The Administrator must run a voluntary Community Rating System to reward communities that go beyond the section 4102 standards to reduce flood and erosion risk, protect natural floodplain functions, and improve floodplain and erosion management. Communities that do more can get discounts (credits) on flood insurance premiums based on how much risk is reduced. If a community got mitigation help under section 4104c, those credits may be phased in to recover that help. The Administrator must report to Congress not later than two years after September 23, 1994 and at least every two years after that about how the program is working. Putting a mobile home back on a site does not make a community ineligible for the flood insurance program if the home was there before, was moved because of flooding, and is replaced within 180 days after the floodwaters drop; “mobile home” is defined by the state’s law.
