The Secretary of Energy can make the rules needed to run the programs in this part and must work with other federal agencies when using certain authorities. The Secretary must report to the President and Congress (and send the report to every State Governor) on how the program is working. The report must estimate energy saved, show how States took part, describe new State programs, and give any recommendations for new laws. The Federal Trade Commission must help State consumer protection agencies and run its own program to stop unfair or deceptive practices tied to energy-saving or renewable measures. Within 90 days after August 14, 1976, the Secretary had to publish a list of energy conservation and renewable measures eligible for certain federal financing and set rules for energy audits. Up to $500,000,000 is authorized for fiscal years 2022 through 2026. That money must be split among States using the distribution formula in effect on January 1, 2021, and it is not subject to the matching requirement in section 6323a. A State Energy Advisory Board is created inside the Department of Energy with 18–21 members, appointed by the Secretary no later than September 30, 1991. At least eight members must be State energy plan directors and at least four must be directors of low-income weatherization programs. Most members must be State employees; others come from private sector, utilities, consumer groups, schools, banks, local government, or research institutions. Members serve three-year terms (the first group had staggered shorter terms). The Board advises the Department on goals, policies, and ways to attract nonfederal funds, connects States with the Department, shares research results, meets at least twice a year, is paid travel expenses, and must send an annual report to the Secretary and Congress. The Board stays in place until a law ends it.
