The chapter does not apply to activities or substances already covered by other federal laws, such as the Federal Water Pollution Control Act, the Safe Drinking Water Act, the Marine Protection, Research and Sanctuaries Act, or the Atomic Energy Act, unless using the chapter would not conflict with those laws. The Administrator must combine and coordinate the rules in this chapter with other federal laws (for example, the Clean Air Act, the Federal Water Pollution Control Act, the Federal Insecticide, Fungicide, and Rodenticide Act, the Safe Drinking Water Act, and the Marine Protection Act) and avoid repeating requirements when possible, so long as doing that fits the goals of each law. As soon as practical after November 8, 1984, the Administrator must report on dioxin emissions from municipal solid waste burning plants, including current data, any important health risks, and operating practices to control those emissions. The Administrator may then publish advisories or guidelines about controlling dioxins, and this does not stop the Administrator from making Clean Air Act rules about dioxins. When sizing waste-to-energy facilities in solid waste plans, planners must account for present and reasonably anticipated future needs, including needs created by full implementation of section 6962(h). Within 90 days after October 21, 1980, the Administrator must review Interior Department rules on coal mining wastes and overburden and tell the Secretary of the Interior any gaps with suggested fixes. The Secretary of the Interior has the exclusive duty to carry out subchapter III requirements for coal mining wastes or overburden tied to a surface coal mining and reclamation permit and, with the Administrator’s agreement, must write and integrate any needed regulations.
