Title 45 › Chapter CHAPTER 20— - NORTHEAST RAIL SERVICE › § 1106
Transfers of railroad property made under this subtitle are not subject to any federal, state, or local taxes or fees on the transfer itself or on recording the paperwork. That includes deeds, bills of sale, liens, easements, and releases of earlier liens. The seller or buyer can record those papers and only must pay normal recording fees that cover the cost of the service. This does not change federal income tax rules. When real property is transferred under part 2 of this subtitle, the new owner gets the same rights and priority as if the deed had been recorded on the transfer date. To keep those rights after 36 months, the buyer must file the proper deeds or papers in the right record office within 36 months. Conrail must help prepare, sign, and submit those papers on time.
