Title 46 › Subtitle Subtitle II— - Vessels and Seamen › Part Part G— - Merchant Seamen Protection and Relief › Chapter CHAPTER 105— - COASTWISE VOYAGES › § 10505
People must not pay a seaman wages before the seaman has earned them, give those advance wages to someone else, or make or take notes, orders, or other debt papers tied to a seaman’s wages for hiring. No one may charge a seaman or a job applicant for getting a job. Violators can be fined up to $5,000, and an illegal advance does not remove the vessel or master’s duty to pay earned wages. The owner, charterer, managing operator, agent, or master seeking U.S. port clearance must show the agreement required by section 10502 at the clearance office. The rule does not apply to fishing or whaling vessels or yachts.
