Title 46 › Subtitle Subtitle II— - Vessels and Seamen › Part Part G— - Merchant Seamen Protection and Relief › Chapter CHAPTER 111— - PROTECTION AND RELIEF › § 11109
Wages owed to a ship’s captain (master) or a crew member (seaman) cannot be taken by a court to pay other debts. A court can only order part of their pay to be used to support their spouse or minor children. Getting paid is valid even if the person earlier tried to sell, assign, or had the wages seized. If someone sells or assigns wages or salvage before they are paid, that sale usually does not bind the seller, except for wage allotments allowed under section 10315. These rules also apply to people who work on fishing vessels or fish-processing vessels.
