When someone files to transfer an interest in a vessel, the person who gets the interest must include a declaration in the form the Secretary requires. The declaration must state citizenship and other facts showing the transfer does not violate sections 56102 or 56103. A corporation’s declaration must be signed by an authorized officer (president, secretary, treasurer, or other authorized official). The transfer is not valid against others until the declaration is filed, unless the Secretary allows an exception. Knowingly making a false material statement in the declaration can lead to a fine under Title 18, imprisonment for up to 5 years, or both.
