§316 Modification by Commission of station licenses or construction permits; burden of proof

Title 47 › Chapter CHAPTER 5— - WIRE OR RADIO COMMUNICATION › Subchapter SUBCHAPTER III— - SPECIAL PROVISIONS RELATING TO RADIO › Part Part I— - General Provisions › § 316

Summary

The Commission can change a station’s license or construction permit for a short time or for the whole term if it thinks the change will help the public or make the law or a treaty be followed. Before the change is final, the license or permit holder must get written notice explaining the reasons and must have at least 30 days to object. If safety of life or property is at risk, the notice period can be shorter. Other licensees who would be affected may also object. Protests must follow the same rules as petitions to deny. If there is a hearing about the change, the Commission must present the evidence and prove its case. But if the issue is whether the change would affect another licensee, the Commission can decide who must go first and who must prove what.
