Agencies must not ask job applicants about their criminal records, in writing, online, or in person, until after the agency gives a conditional job offer. If another law says an employer must check criminal history before a conditional offer, the agency can ask earlier. The rule also does not apply to jobs that need the eligibility checks listed in section 9101(b)(1)(A)(i)-(iii), to Federal law enforcement officers as defined in section 115(c) of title 18, or to jobs the Director of the Office of Personnel Management names in regulations. The Director must consider jobs involving minors, sensitive information, or financial transactions when making those rules, and the rules must follow title VII of the Civil Rights Act of 1964 (42 U.S.C. 2000e et seq.) and other federal civil rights laws.
