If the Secretary finds a State did not follow the Secretary’s rules for certain program funds, the Secretary must tell the President and set the withheld money aside in the Treasury. The money stays there until the end of the next Congress after the State’s legislature meets so the State can ask Congress to reverse the decision. If that Congress does not order payment, the money stays in the Treasury. If any program money already given to a State is lost, reduced, or used wrongly, the State must replace it.
