Analyzed Economic Effects
2 provisions identified: 1 benefits, 1 costs, 0 mixed.
Businesses must disclose exclusive deals
If you are a communications provider (common carrier or MVPD) with an exclusive marketing arrangement in a multi-tenant building, you must include a clear written disclosure on all marketing materials directed at tenants explaining the exclusive marketing right and that other providers may be available. The collection is mandatory (OMB Control Number 3060-1305), covers 515 respondents with 24,000,000 annual responses, is estimated at 3 hours per response, and the total annual burden is 1,545 hours.
Renters get clearer provider disclosures
If you rent in a multi-tenant building, written marketing materials must include a clear notice saying the provider has an exclusive marketing right, that this does not mean it is the only service option, and that alternative providers may be available. The rule aims to reduce tenant confusion and promote competition for communications services in MTEs.
