NJ Air Permits Approved: Business as Usual in Pollution Land

Published Date: 2/28/2025

Rule

Summary

The EPA is giving a thumbs-up to New Jersey’s updated rules for permits and certificates that cover small and some big air pollution sources. These changes make sure new and changed facilities follow clean air standards, helping keep New Jersey’s air fresh and safe. The new rules kick in on March 31, 2025, making it easier for businesses to understand and follow air quality laws without extra costs.

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

NJ permit rules made federally enforceable

The EPA approved New Jersey's N.J.A.C. 7:27 Subchapter 8 (N.J.A.C. 7:27‑8.2 through 8.28) into the State Implementation Plan, effective March 31, 2025. This makes the State's rules for permits and certificates for minor facilities (and major facilities without an operating permit) federally enforceable under Clean Air Act sections 110 and 113. The SIP revisions had State effective dates of September 19, 2011 and January 16, 2018.

Five odor rules and one defense not approved

Five odor-related provisions (N.J.A.C. 7:27‑8.2(d)(3)(ii)(2), 8.2(e)(2)(ii), 8.3(j), 8.4(k)(2), and 8.4(q)) and one affirmative defense provision (N.J.A.C. 7:27‑8.3(n)) were explicitly not approved for inclusion in the SIP. Those listed provisions therefore are not incorporated into the federally enforceable SIP as of the March 31, 2025 effective date.

No new federal burdens; small-entity impact certified low

The EPA states this approval "merely approves State law as meeting Federal requirements and does not impose additional requirements beyond those imposed by State law." The action is certified as "not having a significant economic impact on a substantial number of small entities" under the Regulatory Flexibility Act, and the rule received no public comments during the 30-day comment period.
