Automatic Waiver if Wisconsin Doesn’t Decide
Wisconsin’s Department of Natural Resources has until November 12, 2025 to act on Northern States Power Company’s Clean Water Act section 401(a)(1) certification request filed November 12, 2024. If Wisconsin DNR does not decide by November 12, 2025, the certifying authority is automatically waived under section 401(a)(1), and the project may move forward without the state’s water quality certification.
