Fixed Review Timelines for States

States must open an RDR within 7 days of submission, decide Initial and Reconsideration reviews within 21 days, and decide Final Reviews within 45 days. You must file any Reconsideration or Final Review within 30 days of the State's prior decision, and you get 14 days to provide information if the State asks.

Three-Stage Independent Reviews Required

States must use a three-stage review process: Initial Review, Reconsideration, and Final Review. Reviewers at each stage must be independent from prior reviewers, and the issuing officer cannot be the sole decision-maker when a case is closed as "Closed--No Data Correction Made."

Requestor Carries the Burden of Proof

All DataQs requests (Initial, Reconsideration, Final) must include the factual or legal justification and supporting documentation; the burden of proof is entirely on the requestor. States may procedurally close requests that lack minimal justification (e.g., "Closed--Insufficient Information").

If a State asks for additional information, the requestor has 14 days to respond; failure to respond will lead the State to close the RDR as "Closed--No Requestor Response" unless a decision can be made from the existing record. If the requestor later provides the previously requested information, the State will reopen the request and review it at the level it was closed with the full allotted time.

Compliance Tied to MCSAP Grant Funding

FMCSA will monitor State compliance with the new DataQs requirements and address unwarranted delays through the MCSAP evaluation and approval process; commenters urged that MCSAP funding be linked to compliance and FMCSA may withhold funding for non-compliance.

Time Limits to Challenge Records

You can only ask a State to review inspection records submitted within 3 years from the inspection date, and crash records within 5 years from the crash date. If you have older inspection or crash data you want changed, those requests fall outside these time windows.

Detailed Explanations Required When No Change Made

When a State closes an RDR with the status "Closed--No Data Correction Made," the State must explain the facts and analysis, list evidence reviewed, name the decision-maker (name and title), link to the State's approved Implementation Plan, and provide next steps including appeal instructions.

States Must Submit Implementation Plans

State MCSAP Lead Agencies must submit DataQs Implementation Plans for FMCSA approval. Drafts are due 60 days after the Federal Register notice (by 2026-06-15), final plans 120 days after publication (by 2026-08-14), and the new requirements go into effect 150 days after publication (on 2026-09-13). Approved plans will be posted to DataQs.

MCSAP Funding Can Support Implementation

FMCSA confirmed that support for the new DataQs requirements (hiring staff, training, onboarding, extra personnel hours) is an allowable MCSAP grant expense, and FMCSA will provide training and outreach starting in Spring 2026.
