Requests to Resume Plant Operations

NextEra Energy asked the NRC for three license amendments to support resuming power operations at the Duane Arnold Energy Center and to allow operation through the prior license expiration date of February 21, 2034. The three amendment applications were dated November 20, 2025; December 17, 2025; and January 30, 2026, and the NRC staff has proposed that each involves no significant hazards consideration.

Amendments May Be Issued Before Hearings

The NRC proposes that the three amendment requests involve no significant hazards consideration, and if the Commission makes a final no-significant-hazards determination it may issue and make an amendment immediately effective before the 60-day waiting period or before a hearing. The Commission may also issue an amendment prior to the 30-day comment period if circumstances change and failure to act would prevent resumption of operation.

Safeguards Information Access Fee and Steps

If you want access to Safeguards Information (SGI) to prepare a contention, you must request access within 10 days after publication (by May 4, 2026) and submit a completed Form SF-85, Form FD-258 fingerprint card, and a payment of $403.00 per individual for the background check. The NRC will review standing and need-to-know and conduct background checks before granting SGI access, and SGI-based contentions must be filed no later than 25 days after receipt of the SGI.

Public Filing Deadlines and E-Filing Rules

Public comments must be submitted by May 22, 2026, and requests for a hearing or petitions to intervene must be filed by June 22, 2026. Adjudicatory filings must follow the NRC E-Filing process: obtain a digital ID certificate at least 10 days before the filing deadline, submit documents in PDF, and file electronically no later than 11:59 p.m. ET on the due date.

NEPA Environmental Review and Public Comment

The NRC staff will complete an environmental review under NEPA for the proposed reauthorization actions, prepare an environmental assessment, and issue a draft environmental assessment and draft finding of no significant impact (if appropriate) for public comment. The U.S. Department of Energy, Office of Energy Dominance Financing, will serve as a cooperating agency on the NRC's environmental review.
