FFP Limited to Citizens and Three Groups

Section 71109 of the Working Families Tax Cut (WFTC) limits federal financial participation (FFP) for full Medicaid coverage to U.S. citizens or nationals and to only three groups of noncitizens: lawful permanent residents (LPRs), Cuban/Haitian entrants, or Compact of Free Association (COFA) migrants. CMS describes these three groups as "FFP-eligible noncitizens."

Emergency Medicaid Remains Excepted

Section 71109 does not change emergency Medicaid: expenditures for emergency Medicaid are excepted from the FFP limitations. States must attest in the revised template that they will provide emergency coverage for the treatment of an emergency medical condition.

CHIPRA 214 Option for Children and Pregnant Women

The revised template includes a State option to provide medical assistance to lawfully residing children and pregnant women (the CHIPRA 214 option). Section 71109 did not change this option.

Reasonable Opportunity Period (ROP) Attestation

The revised template proposes a required attestation that the State will provide coverage during a reasonable opportunity period (ROP) while pending verification of U.S. citizenship, national status, or satisfactory immigration status. The template also includes State options related to extending the ROP for noncitizens.
