Must Report Offsets Agreements Over $5M

If your U.S. company sold defense articles or defense services under offsets agreements exceeding $5,000,000 in value, you must report information from calendar year 2025 to the Department of Commerce by June 15, 2026. Submit reports in both hard copy (to the Offsets Program Manager at BIS) and electronically (to the BIS email address provided).

Report Offsets Transactions With $250K+ Credits

If your U.S. firm completed offsets transactions in 2025 for which an offsets credit of $250,000 or more was claimed from a foreign representative, you must report that information to Commerce by June 15, 2026. Reports must cover calendar year 2025 and be submitted in both hard copy and electronically as instructed by BIS.

Firm Data Kept Confidential, Aggregated for Congress

BIS will not publicly disclose individual firm information submitted through offsets reporting unless the firm specifically authorizes public disclosure. Commerce will use the submitted data to prepare an aggregated annual report to Congress that does not identify individual companies.
