JFK Flight Limits Pushed Back Another Two Years

Published Date: 6/23/2026

Rule

Summary

The FAA is extending the rules that limit how many flights can take off and land at JFK Airport until October 28, 2028. This affects airlines flying in and out of JFK by keeping flight numbers in check to reduce delays and congestion. The extension starts October 25, 2026, helping keep travel smoother without extra costs for travelers.

Analyzed Economic Effects

4 provisions identified: 1 benefits, 3 costs, 0 mixed.

JFK hourly flight cap extended

The FAA keeps a cap of 81 scheduled arrivals and departures per hour at John F. Kennedy International Airport during 6:00 a.m. through 10:59 p.m. Eastern Time. This extension takes effect October 25, 2026 and lasts until October 28, 2028 to limit congestion and reduce delays at JFK.

80% slot-usage rule and trading rules

Carriers holding Operating Authorizations (slots) at JFK must use each authorization at least 80% of the time each season or risk withdrawal, with exceptions for Thanksgiving, the Friday after Thanksgiving, and December 24 through the first Saturday in January, and a waiver for highly unusual events lasting five or more consecutive days. Carriers may trade or lease Operating Authorizations for consideration during the Order, but trades and leases require FAA written approval and are subject to FAA review.

Enforcement: fines and court actions possible

The FAA may enforce this Order against carriers by seeking civil penalties under 49 U.S.C. 46301(a) or by filing civil actions in U.S. District Court under 49 U.S.C. 46106 or 46107 to enjoin violations. Carriers that violate the Order may face monetary penalties or court orders preventing further operations that break the Order's terms.

Involuntary slot reductions use weighted lottery

If the FAA requires an involuntary reduction in allocated Operating Authorizations to meet operational needs (for example due to reduced runway capacity), it will conduct a weighted lottery to withdraw authorizations and will provide at least 45 days' notice unless operational needs require otherwise. Withdrawn authorizations that are later reallocated will be given back to the carrier from which they were taken if that carrier continues to operate scheduled service at JFK.
