Carriers may trade or lease Operating Authorizations for consideration during the Order, but trades and leases require FAA written approval and are subject to FAA review.

The FAA may enforce this Order against carriers by seeking civil penalties under 49 U.S.C. 46301(a) or by filing civil actions in U.S. District Court under 49 U.S.C. 46106 or 46107 to enjoin violations. Carriers that violate the Order may face monetary penalties or court orders preventing further operations that break the Order's terms.
Involuntary slot reductions use weighted lottery
If the FAA requires an involuntary reduction in allocated Operating Authorizations to meet operational needs (for example due to reduced runway capacity), it will conduct a weighted lottery to withdraw authorizations and will provide at least 45 days' notice unless operational needs require otherwise. Withdrawn authorizations that are later reallocated will be given back to the carrier from which they were taken if that carrier continues to operate scheduled service at JFK.
