Landowners: Easement and Eminent Domain Risk
If you own land in Weld, Adams, Arapahoe, Elbert, or El Paso counties, Colorado, the pipeline company may contact you to negotiate an easement to construct, operate, and maintain the facilities. You do not have to sign an agreement, but if the Commission approves the project the Natural Gas Act gives the company the right of eminent domain and it could initiate condemnation proceedings in court; compensation would be determined by a judge under state law.
Project Will Disturb 2,268 Acres of Land
Construction of the amended project would disturb about 2,268 acres of land and the Applicants would maintain about 1,068 acres for permanent operation. The amendment adds a net 20.4 acres to construction land needs and 69.8% of the route parallels existing rights-of-way in the listed Colorado counties.
