Copay Exemption for Indian Veterans

If you are an Indian or urban Indian veteran, you are exempt from copayments for hospital care or medical services under laws administered by the VA because Public Law 116-315 (signed January 5, 2021) amended 38 U.S.C. 1730A. The statute uses the definitions at 25 U.S.C. 1603(13) and (28) to define "Indian" and "urban Indian."

Documentation Requirement and Form 10-334

To get the copay exemption, you may be asked to submit documentation that shows you meet the definitions in 25 U.S.C. 1603 and should use VA Form 10-334 as a cover sheet when submitting that documentation. VA estimates 3,000 responses annually, an average burden of 15 minutes per respondent, and a total annual burden of 750 hours; public comments on this information collection are due by August 28, 2026 (OMB Control No. 2900-0920).
