Analyzed Economic Effects
4 provisions identified: 2 benefits, 2 costs, 0 mixed.
Possible Ban on Certain Samsung Phones
The Commission could issue a limited exclusion order that would exclude certain Samsung mobile electronic devices from entry into the United States if it finds a Section 337 violation. The recommended relief specifically targets devices imported, sold for importation, and/or sold after importation by Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc.
Retailers May Lose Samsung Inventory
If the Commission finds a violation and issues cease and desist orders or an exclusion order, retailers and resellers who import or sell the affected Samsung devices could be barred from selling those models in the United States. That would directly affect businesses that stock or plan to stock the identified Samsung devices.
U.S. Producers Might Replace Devices
The Commission is asking whether complainant, its licensees, or third-party suppliers have the capacity to replace the volume of articles potentially subject to the recommended orders within a commercially reasonable time. If excluded, U.S. makers of like or directly competitive articles could supply replacements for the removed Samsung devices.
Public Comment Opportunity and Deadline
Members of the public and government agencies may file written submissions of no more than five (5) pages about the public interest by close of business on August 6, 2026 (Inv. No. 337-TA-1432). Submissions must be filed electronically and may request confidential treatment with a simultaneous redacted non-confidential version.
