Commerce Reviews Chinese Aluminum Foil Subsidies

Summary

The U.S. Department of Commerce found that some Chinese aluminum foil makers got unfair government help during 2024, so they’re reviewing duties (extra taxes) on these imports. Preliminary Duty Rates for Two Firms

Commerce preliminarily found countervailable subsidies for aluminum foil from China for the period January 1, 2024 through December 31, 2024 and assigned preliminary net subsidy rates of 21.62% for Dingheng New Materials Co., Ltd. and 149.69% for Jiangsu Zhongji Lamination Materials Co., Ltd. These preliminary rates apply to imports from those companies for the period of review and can lead to additional duties assessed when final results are issued.

Cash Deposit Rules After Final Results

After the final results of this review are published, Commerce will instruct U.S. Customs and Border Protection to collect cash deposits for shipments entered on or after the date of publication of the final results. Cash deposit rates will equal the company-specific estimated subsidy rates determined in the final results (unless a rate is less than 0.50%, in which case the cash deposit rate will be zero); where producer and exporter rates differ, the higher rate applies; if only one has a company-specific rate, that rate applies; and the all-others rate remains 13.28%.

Review Rescinded for Five Companies

Commerce is rescinding this administrative review for five companies listed in Appendix II (Alcha International Holdings Limited; Baotou Alcha Aluminum Co., Ltd.; Gränges Aluminum (Shanghai) Co., Ltd.; Shanghai Shenyan Packaging Materials Co., Ltd.; and Yinbang Clad Material Co., Ltd.) because petitioners withdrew their review requests. For those companies, Commerce will instruct CBP to assess countervailing duties on appropriate entries at a rate equal to the cash deposit of estimated CVDs required at the time of entry during January 1, 2024 through December 31, 2024, and Commerce intends to issue rescission instructions no earlier than 35 days after publication of this notice.
