Plan Content and Miner Access Requirements
The Rock Burst Control Plan must include mining and operating procedures to reduce rock bursts, monitoring procedures where detection methods are used, and other measures to minimize miner exposure. The plan must be made available to MSHA inspectors and to miners or their representatives.
24-Hour Rock Burst Reporting Rule
If an underground metal/nonmetal mine experiences a rock burst that (i) causes persons to be withdrawn, (ii) impairs ventilation, (iii) impedes passage, or (iv) disrupts mining activity for more than one hour, the mine operator must report that rock burst to the nearest MSHA office within 24 hours.
90-Day Plan Development Requirement
After a rock burst is experienced, an underground metal/nonmetal mine operator must develop and implement a Rock Burst Control Plan within 90 days. The rule also requires that plans be updated as conditions warrant.
