The listed conditions include if either parent is an "alien enemy" (including a member of a designated Foreign Terrorist Organization or a Specially Designated Global Terrorist), is a foreign government employee (ambassador; embassy/consulate employee who is a national of that country; official foreign government employee; or employee of an international organization with immunity), engaged in a commercial transaction to secure birthright citizenship (including paying for the mother to be present or for a U.S.-based surrogate), or the person was born in a U.S. territory/territorial waters where federal law does not confer citizenship. The Secretary of State, Attorney General, Secretary of Homeland Security, and Commissioner of Social Security must align their regulations and policies with this order, and heads of executive departments must issue public guidance by September 5, 2026 (within 30 days).
