Nonimmigrant Visitors Barred for Births
If you enter the United States on a nonimmigrant visa for the purpose of giving birth ("birth tourism"), the Secretary of State and the Secretary of Homeland Security may prevent your entry, deny or revoke your visa or travel authorization, permanently bar you from entry, or remove you from the United States. This authority was delegated under the Executive Order signed August 6, 2026.
Action Against Birth Tourism Facilitators
Entities, organizations, or individuals inside or outside the United States that facilitate or enable birth tourism may face appropriate action by the Secretary of State or the Secretary of Homeland Security. The order authorizes action against those responsible for facilitating entry via nonimmigrant visas for the purpose of giving birth.
Humanitarian and National Interest Exemptions
The Secretary of State or the Secretary of Homeland Security may exempt a foreign national from actions under this order on humanitarian grounds or if their entry is in the national interest, as those Secretaries determine. Exemptions are discretionary and applied at the Secretaries' judgment.
