Who May Sell Alcohol on Reservation

The Pueblo itself may sell alcoholic beverages on the reservation for on-premises consumption only. The Tribal Council may also license a person or entity (by lease, sublease, or other document) to sell alcoholic beverages for on-premises or off-premises consumption as the license terms specify; the ordinance was adopted by Resolution No. TC-007-26 on March 17, 2026 and becomes effective August 21, 2026.

Fees and Taxes Payable to the Pueblo

Fees, charges, and income from alcoholic beverage sales by the Pueblo must be paid to the Ysleta del Sur Pueblo rather than the State of Texas. Fees, charges, and taxes payable by a third-party licensee may be payable either to the Pueblo or to the State of Texas as the applicable fee or tax provides.

Local Enforcement and New Commission

The Pueblo is solely responsible for enforcing this ordinance and created the Tigua Tobacco and Alcohol Commission to issue and enforce regulations. The Commission will have one Commissioner and two members, all tribal members, who must have no ownership interest in companies that contract with the Pueblo for alcohol or tobacco sales and who serve at the pleasure of the Tribal Council.

Ban on Unlicensed Alcohol Sales

No individual, entity, or organization may sell or dispense alcoholic beverages on the Pueblo's reservation except the Pueblo itself or an individual, entity, or organization licensed by the Tribal Council. Unlicensed sales or dispensing on the reservation are therefore prohibited under the amended ordinance effective August 21, 2026.
