Summary

This notice publishes the Caddo Nation of Oklahoma Liquor Control. The liquor control code is to regulate and control the possession, sale, manufacture and distribution of alcohol in conformity with the laws of the State of Oklahoma for the purpose of generating new Tribal revenues. Enactment of the code will help provide a source of revenue to strengthen Tribal government, provide for the economic viability of Tribal enterprises and improve delivery of Tribal government services.

Large fines, seizure, and business closure powers

The Commission may impose civil penalties of up to Five Thousand Dollars ($5,000.00) per violation, seize and forfeit contraband alcohol, and seek injunctive closure of a business for up to one (1) year. For certain nuisance remedies the owner may be required to post a bond of no less than Twenty-Five Thousand Dollars ($25,000).

You must be licensed to sell alcohol

If you want to sell, manufacture, distribute, or serve alcoholic beverages on Caddo Nation Tribal lands, you must hold a license issued by the Caddo Nation Tax Commission. Licenses are issued only to applicants operating on Tribal lands and are valid for up to two (2) years; renewals require a new application and payment and must be submitted 60 to 90 days before expiration.

Tribe will add excise taxes and tax stamps

The Caddo Nation may assess and collect a tribal tax on the sale of liquor and beer, add an excise tax set by the Tribal Council to the retail price, and require Caddo Nation tax stamps on products. Taxes and reports must be remitted to the Commission on a monthly basis unless regulations say otherwise.

Recordkeeping, tax stamps, and monthly audits required

Operators must keep originals or accurate electronic copies of purchase records, invoices, sales slips, cancelled checks, and accounting records for at least five (5) years; retailers may possess only tax-stamped products. Books and records are subject to inspection and audit by the Commission during normal business hours.

Licensees consent to Tribal jurisdiction

Anyone who applies for or accepts a license consents to the exclusive jurisdiction of the Caddo Nation of Oklahoma for matters under this code, and the Tribal Court has exclusive jurisdiction over dram shop actions. The Nation retains sovereign immunity.

Minimum legal drinking age and ID rules enforced

The legal age to possess or consume alcohol on Tribal lands is twenty-one (21). Sellers must not serve persons under 21, may require ID, and may accept a driver's license, Tribal/state ID, military ID, or passport as proof of age. Use or attempt to use false or altered ID is a violation.

Payment and sales rules at point of sale

All retail sales of alcoholic beverages on Tribal lands must be conducted on a cash-only basis, although sellers may accept commercial credit cards (e.g., VISA, MasterCard, American Express). Resale of purchased alcohol by unlicensed parties is prohibited.

Insurance, bonds, and other operator financial duties

Each operator must maintain adequate insurance (liability, fire, theft, vandalism) at their own expense and may be required to furnish a bond guaranteeing payment of Nation taxes. The Commission may also require minimum insurance levels as a license condition.
