Summary

On September 4, 2026, the U.S. Court of International Trade (CIT) issued its final judgment in Wind Tower Trade Coalition v. United States, Court no. 24-00070, sustaining the U.S. Department of Commerce (Commerce)'s remand results pertaining to the administrative review of the antidumping duty (AD) order on utility scale wind towers (wind towers) from the Republic of Korea (Korea) covering the period August 1, 2021, through July 31, 2022. Commerce is notifying the public that the CIT's final judgment is not in harmony with Commerce's final results of the administrative review, and that Commerce is amending the final results with respect to the dumping margin assigned to Dongkuk S&C Co., Ltd. (Dongkuk).

Entries enjoined; possible duty assessment if final

Entries of wind towers produced and exported by Dongkuk that were entered or withdrawn for consumption during August 1, 2021 through July 31, 2022 remain enjoined from liquidation by a CIT order. If the CIT ruling is not appealed or is upheld on appeal, Commerce intends to instruct U.S. Customs and Border Protection to assess antidumping duties on unliquidated entries in accordance with 19 CFR 351.212(b), except where the importer-specific ad valorem assessment rate is zero or de minimis.

Dongkuk dumping margin amended to 1.90%

Commerce amended the final weighted-average antidumping duty margin for Dongkuk S&C Co., Ltd. to 1.90 percent. This amendment is tied to the administrative review covering entries from August 1, 2021 through July 31, 2022 and is applicable as of September 14, 2026.

Current cash deposit rate remains unchanged

Commerce will not issue revised cash deposit instructions to U.S. Customs and Border Protection because Dongkuk has a superseding cash deposit rate from a subsequent administrative review. This notice does not affect the current cash deposit rate for Dongkuk.
