Build America, Buy America Sourcing Rule
If your organization receives USDA federal financial assistance for an infrastructure project, you may not use those funds unless: (1) all iron and steel used in the project are produced in the United States, (2) all manufactured products used in the project are produced in the United States, and (3) all construction materials are manufactured in the United States. USDA agencies may approve waivers to these sourcing requirements in accordance with BABAA sections and OMB Memorandum M-22-11.
Waiver Request Info Collection Burden
USDA will collect BABAA waiver requests and supporting documentation electronically (submitted via email) from respondents identified as state, local, and Indian tribal governments, institutions of higher education, and nonprofit organizations. The collection lists 200 respondents, reporting annually, with a total estimated burden of 6,000 hours. The General Services Administration is developing a web-based BABAA electronic submission system that USDA expects to use when available, but no completion date is provided.
