Show full summary
  • Families and beneficiaries: Survivors and dependents eligible under 38 U.S.C. §3510 are added to the in-state tuition determination rules, widening who can trigger in-state rates.
  • Public colleges: The Department of Veterans Affairs may disapprove courses at public institutions that do not charge veterans the in-state tuition rate for the program, which creates pressure on schools to offer in-state pricing to covered students.
  • Implementation: The statute adds category "35" to cross-references in 38 U.S.C. §3679 and applies to academic periods beginning on or after August 1, 2022.

In-state tuition for VA survivors

The law adds students using VA survivor or dependent education benefits to the in-state tuition rule at public colleges. If you get these benefits, a public school must charge you the in-state rate to stay approved for VA benefits. VA can disapprove courses if a school does not comply. This applies to academic terms that begin on or after August 1, 2022.
