Supplemental Impact Aid Flexibility Act

Sponsored By: Senator Thune, John [R-SD]

Became Law

Summary

Allows local school districts to reuse 2022 Impact Aid data for 2023 payments. It gives districts specific alternative options to calculate 2023 Impact Aid so COVID-19 reporting disruptions do not cut off federal support.

Show full summary
  • Local educational agencies that submitted an application for fiscal year 2022 may choose to use their 2022 application data when applying for fiscal year 2023. This preserves eligibility and payment continuity for districts that faced COVID-19 disruptions.
  • For payments under section 7002, a district may either use the data it submitted under ESEA section 7002(j) in 2022 or use the data normally required for fiscal year 2023.
  • For payments under section 7003, a district may either reuse the 2022 student count data or use the student counts required for fiscal year 2023. If a district reuses 2022 counts, the Secretary will calculate the 2023 payment using the fiscal year 2023 expenditures and rates specified in the law.

School districts get 2023 Impact Aid flexibility

For fiscal year 2023, school districts that applied for Impact Aid in 2022 and 2023 can choose which data to use. For federal property payments, a district can reuse its 2022 data or submit new 2023 data. For basic support payments, a district can reuse 2022 student counts, but the Education Department still uses 2023 spending rates; or the district can submit 2023 student counts. The district must make its choice in its 2023 application. This flexibility starts on enactment and ends at the close of fiscal year 2023.
