Ensuring the Best Schools for Veterans Act of 2022

Sponsored By: Senator Tester, Jon [D-MT]

Became Law

Summary

Limits courses where more than 85% of students have tuition or fees paid by the school or by VA benefits. It also creates a faster, formal review for schools that challenge that threshold and spells out carve-outs, waivers, and biennial checks to reduce unintended blockages for veterans.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

85% course cap with new carve-outs for veterans

The VA does not approve a new veteran’s enrollment in a course when more than 85% of students have tuition paid by the school or VA. Some courses are exempt. If most courses at a campus are VA‑approved and veterans make up 35% or less of total students there, the 85% limit does not apply at that campus. The 35% test is done for each main campus and each branch. Programs with fewer than 10 paid students are exempt, and certain listed course types and farm cooperative training are also exempt. Payments under a plan that finishes within 180 days after a term ends do not count toward the 85% figure if VA finds the school has that history. The VA Secretary can waive the 85% rule when it serves the veteran and the government. These rules apply to terms starting on or after the law’s enactment.

Faster VA reviews and lighter school reporting

Schools can ask the VA to review an 85% decision within 30 days after a term starts. The Under Secretary aims to decide within 30 days, and the Secretary can make a final decision. This review happens outside the usual Chapter 51 process. Schools that meet the 35% campus exemption verify with VA every two years. While verified, VA cannot require extra 85% reporting. These rules apply to terms starting on or after the law’s enactment.
