Summary
Fixed 120-day deadline for federal royalty allocation decisions. The law requires the Secretary to issue allocation determinations within 120 days of a request and creates short timelines for reporting, correcting payments, and a limited interest waiver.
Show full summary
- For oil and gas lessees: They must report and pay royalties each production month based on the proposed allocation until the Secretary issues a determination. After receiving the determination they must correct reports and any underpayments by the end of the third month after the decision.
- For royalty owners and claimants: The rule gives a clear, timebound path to a final allocation, which shortens the period of uncertainty about who is owed royalties under unit and communitization agreements.
- For Indian lands and tribes: The law excludes units or communitization agreements that contain Indian lands from the interest waiver provision, so the temporary interest relief does not apply to those arrangements.

Faster royalty allocation decisions for oil and gas operators
The law sets a 120-day deadline for allocation decisions on oil and gas units and communitization agreements. Until a decision, lessees or their designees must report and pay royalties each production month using the proposed allocation. After the decision, they must correct reports and payments as needed by the end of the third month following the month they receive it. If royalties were paid fully and on time to all parties under the proposed allocation, the Secretary waives interest on those obligations until that same third month. These rules do not apply to agreements that include Indian lands.
