All-American Flag Act
Sponsored By: Senator Brown, Sherrod [D-OH]
Became Law
Summary
Requires federal agencies to buy United States flags that are 100 percent grown, produced, and manufactured in the U.S. It adds a new Section 6310 to Title 41 and allows an availability exception if an agency head determines domestic flags of satisfactory quality and sufficient quantity cannot be procured at U.S. market prices. Three specific exceptions apply: purchases by vessels in foreign waters, items for resale in military commissaries/exchanges and nonappropriated fund stores, and purchases below the simplified acquisition threshold. The President may waive the requirement to comply with a trade agreement and must publish a notice of any waiver within 30 days. The rule applies to contracts entered into 180 days after enactment.

Federal agencies must buy U.S.-made flags
Beginning 180 days after enactment, executive agencies may only buy U.S. flags that are 100% made in America. The flags must use materials that are 100% grown or made in the United States. The rule applies to contracts signed on or after that date. An agency head can allow a purchase if enough good‑quality U.S. flags at U.S. market prices are not available. The rule does not apply to buys by vessels in foreign waters, to flags for resale in commissaries or exchanges, or to purchases below the simplified acquisition threshold. The President may waive the rule to follow a trade agreement and must publish the waiver in the Federal Register within 30 days.
