Introduced

Summary

Gives Congress and the states the power to limit campaign contributions and spending. This proposed constitutional amendment would authorize reasonable regulation of money in federal, state, and local elections and in ballot initiatives. It frames political equality, representative self‑government, freedom of speech, and election integrity as compelling public interests and expressly allows laws that treat natural persons differently from corporations and other artificial entities, including laws that bar those entities from raising or spending money in campaigns and ballot measures.

  • Voters and civic equality: Frames political equality and election integrity as reasons governments may reduce the influence of large sums on political outcomes, potentially changing who has the loudest voice in campaigns.
  • Candidates and campaigns: Would let Congress and state legislatures write rules on contribution caps, spending limits, registration and reporting, exemptions, and enforcement that reshape campaign financing and fundraising.
  • Corporations and artificial entities: Explicitly permits laws that distinguish natural persons from corporations, unions, and other entities and that could prohibit those entities from raising or spending money in elections and ballot initiatives.

New constitutional power to limit campaign money

This bill would add a new article to the Constitution about elections and campaign money. It would say the people have strong interests in free speech, representative government, federalism, election integrity, and political equality. It would say nothing in the Constitution prevents Congress or the States from reasonably regulating and limiting contributions and spending in campaigns for public office and in state or local ballot initiatives and referendums. It would allow laws to treat natural persons differently from corporations or other artificial entities and to bar those entities from raising or spending money in such campaigns. It would let Congress and the States pass laws to implement and enforce these rules. To become part of the Constitution, it would need ratification by three-fourths of state legislatures within seven years after submission.
