Caring for All Families Act
Sponsored By: Representative Hayes, Jahana [D-CT-5]
Introduced
Summary
Expands who counts as family under FMLA and would create a new short parental involvement and family wellness leave. It would also align private-sector and federal rules so definitions, eligibility, scheduling, certification, and pay-substitution work the same for both groups.
Show full summary
- Families: People with close personal bonds beyond traditional legal ties would become eligible for leave. That list includes domestic partners, grandchildren, grandparents, in-laws, nieces, nephews, siblings, and any other person whose relationship is the equivalent of family.
- Workers: Eligible employees would be able to take leave to attend school or community activities, routine medical or dental appointments, or to care for elderly individuals with a close personal bond. That new leave would be limited to 4 hours in any 30-day period and 24 hours in a 12-month period.
- Employers and federal agencies: Employers could require certification under rules set by the Secretary and must allow intermittent or reduced-schedule use consistent with the law. Private employees may substitute accrued vacation or sick leave, and federal agencies may not impose stricter substitution rules than the bill allows.

Federal workers could use leave for more family
If enacted, federal employees would have matching rules that count more people as family for leave. You could take leave for a domestic partner, in‑laws, grandparents, grandchildren, siblings, aunts, uncles, nieces, and nephews. You could also take leave for another close person with a family‑like bond, and a domestic partner’s child could count as an adult child in some cases. Normal Title 5 eligibility and job/benefit protections would apply. Agencies could require certification that includes how much time you are needed.
Workers could use FMLA for more family
If enacted, more people would count as family for FMLA leave at covered private employers. You could take leave for a domestic partner, in‑laws, grandparents, grandchildren, siblings, aunts, uncles, nieces, and nephews. You could also take leave for another close person with a family‑like bond. A domestic partner’s child could count as an adult child in some cases. Normal FMLA eligibility and job/health‑benefit protections would apply, and employers could ask for a certification that includes how much time you are needed.
Short leave for school and checkups
This bill would add a small new FMLA leave. You could use up to 4 hours in any 30 days, and up to 24 hours in a year. You could attend school or community events for your child or grandchild, go to routine medical or dental visits for you, your spouse or domestic partner, your son or daughter, or your grandchild, or visit and help an elderly person with a family‑like bond. This would be on top of other FMLA leave. Employers could require about 7 days’ notice and a certification, and you could use accrued paid vacation or sick time where allowed.
