Where the new tax money goes
If enacted, the bill would direct one-fifth (20%) of the new data center electricity tax to each of several funds and programs. It would send 20% to the Land and Water Conservation Fund and 20% to the Housing Trust Fund. It would send 20% to the Hazardous Substance Superfund and 20% to a new Energy Technology Trust Fund. The Energy Technology Trust Fund would be available, as appropriated, to cover the cost of Title XVII loan guarantees. For the Highway Trust Fund, the bill would use the greater of certain pre-October 1, 2028 fuel and vehicle tax receipts or 20% of the new tax when calculating transfers. The bill would also treat the LWCF and Housing Trust Fund amounts under a specific budget accounting rule.
New excise on data center power
If enacted, this bill would impose a new federal excise tax of 1 cent per kilowatt-hour on electricity used by "data centers." It would apply to facilities that mainly hold electronic equipment and that have a peak power capacity above 1 megawatt. The tax would apply to electricity used after enactment. Data center owners would pay more, and those higher costs could be passed on to cloud and hosting customers.
