No Data Center NDAs Act

Sponsored By: Representative Barrett, Tom [R-MI-7]

Introduced

Summary

Would prohibit Members of Congress from signing nondisclosure agreements to obtain information about planning or developing data centers. It would bar use of federal funds to implement or enforce those NDAs, require the House Committee on Ethics and the Senate Select Committee on Ethics to issue rules to carry out the ban, and relies on the Energy Independence and Security Act of 2007 for the definition of "data center".

Ban NDAs for data center planning

If enacted, Members of Congress would be prohibited from signing nondisclosure agreements with state or local governments or private entities as a condition for getting information about data center planning or development. Covered information would include planned or received investments, location planning, construction designs, and water or energy resource consumption. The House Committee on Ethics and the Senate Select Committee on Ethics would have to write regulations to carry out the ban. No funds appropriated or otherwise made available from the U.S. Treasury could be used to implement or enforce those NDAs, and this change would take effect upon enactment.
