Bill Overview

Analyzed Economic Effects

5 provisions identified: 5 benefits, 0 costs, 0 mixed.

Lower insulin costs for insured people

If enacted, group and individual health plans would have to cover selected insulin products with no deductible. For each 30-day supply you would pay the lesser of $35 or 25% of the negotiated price after price concessions. Before 2028 a $35 per-30-day cap would apply. Plans generally could not require prior authorization for selected insulin, and plans could limit coverage to the plan's chosen "selected insulin products" (at least one dosage form and device per insulin type).

Faster review pathway for biosimilars

If enacted, the Secretary would be able to designate a biosimilar as a "competitive biosimilar" and allow expedited development and review. Sponsors could request the designation with or up to 60 days before their application, and the Secretary could decide within 60 days. The designation would apply only when there are fewer than three licensed products using the reference biologic and at least three years have passed since expiration of all applicable exclusivity.

Help for uninsured people needing insulin

If enacted, HHS would award grants to set up an insulin resource center and a 24/7 voice-and-text hotline to help uninsured people find affordable insulin. Grantees would run a ZIP-code searchable website linking to health centers and pharmacies, give impartial info about assistance programs, help people enroll, provide culturally and linguistically appropriate help, and do outreach with hospitals and community groups. Grantees could not be insulin manufacturers or accept manufacturer payments tied to enrollment. The program is authorized $2,000,000 per year for fiscal years 2027 through 2032.

Patient protections and timing rules

If enacted, selected insulin benefits would get existing patient-protection rules for plan years starting January 1, 2028. The bill would also say removing a deductible for those insulin products would not count as raising a plan's actuarial value for marketplace rules. HHS, Labor, and Treasury would be allowed to implement these title rules by guidance for plan years starting Jan 1, 2028 and ending no later than Jan 1, 2030, and the Paperwork Reduction Act would not apply to these provisions.

Study on uninsured insulin users

If enacted, the Government Accountability Office would study uninsured people who use insulin and report within two years of enactment. The report would look at where they live, why they are uninsured, race and ethnicity, and income levels, and it would consult patient, clinical, and provider groups and other experts.
