Disaster Relief Fairness Act of 2026
Sponsored By: Representative Amo, Gabe [D-RI-1]
Introduced
Summary
Automatically approve certain disaster declarations during January 20, 2025 to January 20, 2029 so federal aid flows faster when objective damage thresholds or FEMA regional findings show major need. The bill would treat qualifying state or tribal requests as approved and stop deadline misses from alone blocking aid.

More disaster aid for households
If enacted, this bill would set a temporary rule for major disaster requests made between January 20, 2025 and January 20, 2029. It would treat a section 401 request from a State Governor or tribal chief as approved if either FEMA's joint preliminary damage assessment meets the per-person or public-assistance cost indicators in 44 C.F.R. 206.48(a) (as of enactment) or a FEMA Regional Administrator finds individual assistance warranted under 44 C.F.R. 206.48(b) (as of enactment). When a covered request is treated as approved, the President would be required to provide the requested Stafford Act assistance. The bill would also prohibit denying or withholding Stafford Act aid for a covered request solely because a deadline was missed.
