China FIREWALL Act of 2026
Sponsored By: Representative Gottheimer, Josh [D-NJ-5]
Introduced
Summary
Blocks executive-branch use and procurement of AI tools from foreign entities of concern. It would require the Office of Management and Budget to set standards within 60 days to remove covered applications from agency IT and to align those standards with federal information security rules. The bill also creates narrow exceptions and a case-by-case waiver path for national security uses.

- Federal agencies would have to remove covered applications from their information technology and follow OMB standards issued within 60 days. Agencies must document risk mitigation for any authorized exception and follow federal information security requirements.
- Procurement would bar agency heads from buying any covered application or any software that uses a foundation model developed or provided by a foreign entity of concern. This restricts federal contracting for such AI products.
- The bill spells out key definitions. A “foundation model” is an AI component trained on broad data and adaptable to many tasks. The definition and the reference to “foreign entity of concern” shape which products are included and how the ban is applied.

Limits federal use of certain foreign AI
If enacted, the bill would prohibit executive agencies from procuring or using AI applications developed or provided by foreign entities of concern. The Office of Management and Budget would have 60 days after enactment to issue standards, in consultation with the General Services Administration, the Cybersecurity and Infrastructure Security Agency, the Director of National Intelligence, and the Secretary of Defense, to remove covered applications from agency IT. Exceptions would be allowed for law enforcement, national security activities, and security researchers, and agencies using an exception would have to document risk-mitigation steps. The OMB Director could also grant case-by-case waivers in the interest of national security after the same consultations.
