Permanent residence pathway for Hong Kongers

If enacted, the bill would let qualifying Hong Kong permanent residents adjust to U.S. lawful permanent resident status. To qualify, you would need Deferred Enforced Departure from the August 5, 2021 Presidential memorandum or the January 26, 2023 or January 15, 2025 extensions. You would need to have lived continuously in the United States since January 15, 2025, with no more than 180 days of authorized absences in total. You must not have returned to Hong Kong or the People’s Republic of China since January 15, 2025, have a felony or two U.S. misdemeanors, or be subject to extradition. You would need to submit an application within one year after the bill’s enactment. Spouses, children, and unmarried adult sons and daughters could also adjust, subject to other admission rules; the bill would waive several specific listed grounds of inadmissibility and deportability for these applicants. The bill would exempt these adjustments from the usual numerical green-card limits. While your application is pending, you would be protected from immigration detention, removal, and removal proceedings, and you would be authorized to work. If approved, prior removal orders would be cancelled and your permanent-resident status would be effective from your arrival date.
