  • Officers chosen for promotion would get a written determination that names the specific ground, lists factual findings and supporting evidence, and allows them to submit written responses. If an officer petitions a correction board within 15 days after notice of a final determination the removal would be stayed pending review.
  • The bill would limit removal to enumerated bases like misconduct, newly discovered material adverse information, failure to meet statutory qualifications, or national security necessity, and it defines misconduct by specific findings and actions. The Secretary would need substantial evidence to support removals.
  • Boards for Correction of Military Records would have an expedited review option with decisions due within 180 days, and if a board vacates the adverse information the Secretary must reconsider the promotion and issue a new written determination. The Secretary must also adopt implementing procedures within 180 days of enactment.
