Sponsored By: Representative Subramanyam, Suhas [D-VA-10]

Introduced

Summary

This bill would allow selected nonimmigrant visa holders to renew their visas from within the United States. It targets a set of specific visa categories and aims to reduce the need for travelers to leave the country for consular renewals.

Show full summary
  • Families and individual visa holders in the listed categories would often avoid travel abroad for renewals, making status maintenance simpler and less disruptive.
  • Workers sponsored under the listed categories, including subparagraphs E, H(i)(b), H(i)(b1), I, L, O, and P, would be able to apply for renewal from inside the U.S. if they meet conditions like registration and fingerprinting, interview‑waiver eligibility, an approved and unexpired petition when required, a lawful unexpired visa, and intent to reenter after any temporary departure.
  • Employers and program sponsors could face fewer staffing interruptions because renewals could proceed domestically rather than depending on consular appointments abroad, and consular workloads would be reduced by shifting some renewal processing to the U.S.

Renew certain work visas inside U.S.

If enacted, eligible noncitizens would be able to apply to renew certain visas without leaving the United States. This would apply to valid, unexpired E, H(i)(b), H(i)(b1), I, L, O, and P visas. To use this in-country renewal, you would need to have been registered and fingerprinted under section 221(b), not be ineligible for the visa, be eligible for an interview waiver under section 222(h), not be subject to a reciprocity fee, and, if required, be the beneficiary of an approved and unexpired petition. If you had temporarily departed the United States, you would need to intend to reenter under one of the listed visa categories. The change would take effect upon enactment.
