More Title IX rights for students
If enacted, the bill would make schools and other recipients of federal education funds directly liable when an employee or agent uses their authority to enable sex-based harassment that limits a person’s access to programs, even if the conduct happened off campus. It would also make entities liable for harassment by employees or third parties when the entity knew or should have known and cannot show it exercised reasonable care. Reasonable care would include a public prevention policy and complaint process, prompt impartial investigations when requested or needed, supportive measures regardless of whether an investigation is filed, and immediate corrective action after notice. The bill would let any person harmed by a Title IX failure sue in court and seek equitable relief, compensatory or punitive damages, and attorney and expert fees.
