Temporary protected status for Ukrainians
If enacted, the bill would designate Ukraine for temporary protected status (TPS) from October 20, 2026 through July 1, 2029. Eligible nationals of Ukraine and stateless people who last habitually resided in Ukraine would be able to apply for TPS if they have continuously resided and been continuously physically present in the United States since the date of enactment, meet immigrant-admissibility rules and TPS ineligibility bars, and register as the Secretary of Homeland Security directs. If the Act is enacted after October 20, 2026, the designation would apply retroactively to that date and otherwise eligible people would not be treated as having accrued unlawful presence for that period. The Secretary would have to receive and process TPS and related employment-authorization applications and complete each adjudication within 90 days after receipt. The Secretary would also have to give prior consent for brief emergency travel abroad when an applicant shows emergency, extenuating circumstances beyond their control, and returning TPS holders would be treated like other returning TPS recipients.
