Sponsored By: Representative Mills, Cory [R-FL-7]
Introduced
Summary
Prevents companies tied to the People's Republic of China from qualifying as small businesses for SBA programs. This bill would add a new rule to the Small Business Act that bars a concern from being treated as a small business for SBA purposes if it is incorporated and located in the People's Republic of China or if affiliates that are citizens of or organized under PRC law own more than 25% of its voting stock.
Show full summary
- Firms incorporated and located in the People's Republic of China would be excluded from small-business status under the Small Business Act and thus from SBA assistance tied to that status.
- Businesses with over 25% of voting stock owned by PRC-affiliated entities would lose small-business designation and become ineligible for SBA programs that depend on that designation.
- The change applies only for purposes of the Small Business Act, so it specifically alters who counts as a small business for SBA eligibility decisions and does not rewrite other federal definitions.

No SBA help for China-linked firms
This bill would change who counts as a small business for SBA programs. A firm located and incorporated in China would not count as a small business. A firm would also be ineligible if affiliates that are citizens of, or organized under the laws of, the People’s Republic of China own over 25% of its voting stock. This would block those firms from SBA loans, set-asides, and certifications. It would take effect upon enactment.
