National Patient Safety Board Act of 2026

Sponsored By: Representative Barragán, Nanette Diaz [D-CA-44]

Introduced

Summary

Prevent and reduce patient safety events. This bill would create the National Patient Safety Board inside the Department of Health and Human Services to monitor risks, study causes, and recommend systemwide solutions.

Show full summary
  • Patients and families would get a public Patient Safety Reporting System to report events and receive responses, and the Board would analyze disparities by race, ethnicity, gender, age, social factors, facility, and location.
  • Health care workers and providers would face independent studies that can access participating facilities and stakeholders. Board reports are generally not admissible in civil cases, HHS may not use Board work to punish providers, and employee cooperation is protected from discharge or discrimination.
  • Federal agencies and researchers would feed a new Patient Safety Research and Development Division that could obtain longitudinal, de-identified patient-level data from HHS and VA. A five-member Presidential-appointed Board would oversee three divisions and convene a public–private Health Care Safety Team with agencies like AHRQ, CDC, CMS, VA, FDA, and NIH to develop measures and surveillance tools.
