REAL Political Advertisements Act

Sponsored By: Representative Clarke, Yvette D. [D-NY-9]

Introduced

Summary

AI disclosure for political ads would require clear, prominent labels when image or video in a political communication is generated by artificial intelligence and would expand which paid online or digital ads count as electioneering communications on very large platforms.

Show full summary
  • Voters would see explicit notices on AI-generated images and video in political communications, making manipulated content easier to spot.
  • Campaigns and paid advertisers would have to include a special AI disclaimer with format rules: readable text for graphics, audio statements of at least 3 seconds, and video notices that show written text for 4 seconds plus a 3 second audible statement. These rules would take effect January 1, 2027.
  • Online platforms and third-party ad vendors with 50 million or more unique U.S. monthly users for most months would fall under the expanded electioneering definition.
  • The Federal Election Commission (FEC) would get 120 days after enactment to write implementing rules and must report to Congress within two years and then every two years about compliance and enforcement.
  • News stories, commentary, and editorials remain exempt but the exemption would not apply to online facilities owned or controlled by political parties, candidates, or committees.
